Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Skyscraper ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Skyscraper provides a suite of Bluesky tools including:

Skyscraper iOS/macOS App

A third-party client application that provides access to the Bluesky social network through the ATProtocol. The App allows you to:

• View and create posts on Bluesky
• Follow and interact with other Bluesky users
• Send and receive direct messages
• Browse custom feeds and discover content
• Manage multiple Bluesky accounts
• Receive push notifications for account activity
• Access other features provided by the Bluesky network

Skyscraper Tools (Web Service)

A web-based service at api.getskyscraper.com/tools that provides:

• Keyword Alerts: Monitor Bluesky for specific keywords and receive email notifications
• Account Backups: Download complete archives of any public Bluesky account
• Trending Hashtags: Real-time trending hashtag data from Bluesky

3. Bluesky Account Required

To use Skyscraper, you must have a valid Bluesky account. You are responsible for:

• Creating and maintaining your Bluesky account in compliance with Bluesky's Terms of Service
• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Using app passwords as recommended by Bluesky for third-party applications

4. User Conduct

You agree to use Skyscraper in compliance with:

• All applicable laws and regulations
• Bluesky's Terms of Service and Community Guidelines
• These Terms of Service

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated tools or bots to spam or abuse the Bluesky network
• Interfere with or disrupt the App or Bluesky's servers
• Violate any intellectual property rights

5. Third-Party Service

Skyscraper is an independent third-party application and is not affiliated with, endorsed by, or sponsored by Bluesky. We do not control the Bluesky network or its content. Your use of Bluesky through Skyscraper is subject to Bluesky's terms and policies.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of content
• Warranties that defects will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the App
• Any damages arising from Bluesky's service interruptions or changes
• Any content posted by users on the Bluesky network

8. Skyscraper Tools Subscriptions

Skyscraper Tools offers subscription plans with the following terms:

Subscription Tiers

• Skyscraper Tools Basic: $5/month or $20/year - Includes 2 account backups per day and keyword alerts
• Skyscraper Tools Premium: $20/month or $200/year - Includes 10 account backups per day, priority processing, and all Basic features

Payment Terms

• Payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account dashboard
• Refunds are handled on a case-by-case basis; contact support for assistance

Account Backup Terms

• Backups are of public Bluesky account data only
• Download links expire after 36 hours
• Backup files are permanently deleted from our servers after expiration
• You are responsible for how you use downloaded backup data

9. Updates and Modifications

We reserve the right to:

• Modify or discontinue the App or Services at any time without notice
• Update these Terms of Service at any time
• Add or remove features from the App or Services
• Change pricing for subscription plans with reasonable notice

Continued use of the App or Services after changes constitutes acceptance of modified Terms.

10. Data and Privacy

Your use of the App and Services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we handle your information. Key points:

• We store your credentials securely in your device's Keychain (iOS/macOS app)
• We communicate directly with Bluesky's servers using the ATProtocol
• Skyscraper Tools accounts use securely hashed passwords
• We do not sell or share your personal information

11. Intellectual Property

The App, including its code, design, and trademarks, is owned by Cameron Banga and is protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works of the App
• Use our trademarks without permission
• Remove any copyright or proprietary notices

12. Termination

We reserve the right to terminate or suspend your access to the App or Services at any time, for any reason, without notice. You may stop using the App at any time by deleting it from your device, or cancel your Skyscraper Tools subscription through your account dashboard.

13. Platform Guidelines

Your use of Skyscraper through Apple's App Store is also subject to Apple's Terms of Service and App Store Review Guidelines.

14. Beta Testing

If you are participating in TestFlight beta testing:

• The App may contain bugs or incomplete features
• Features may be added, removed, or changed without notice
• Beta versions are provided for testing purposes only
• You agree to provide feedback and report bugs as appropriate

15. Indemnification

You agree to indemnify and hold harmless Cameron Banga and Skyscraper from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content posted through the App

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the App or Services shall be resolved in the courts of the State of Indiana.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and Cameron Banga regarding the use of Skyscraper and its services, and supersede all prior agreements and understandings.
